Draft Resolution on the shared use of technical infrastructure and telecommunications infrastructure of agencies, organizations, and enterprises to perform national defense tasks, protect national security, and ensure social order and safety.

This draft Resolution consists of 9 articles, providing mechanisms and policies for the sharing and joint use of technical infrastructure facilities and telecommunications infrastructure of agencies, organizations and enterprises to perform national defense missions, protect national security, and ensure social order and safety. It applies to ministries, ministerial-level agencies, government-attached agencies, People's Committees at all levels, and other relevant agencies, organizations, enterprises and individuals involved in the joint use of technical infrastructure facilities and telecommunications infrastructure specified in Clause 1 of this Article.

Notably, the Ministry of Public Security also proposes solutions to implement mechanisms and policies for the sharing and joint use of technical infrastructure facilities and telecommunications infrastructure. In particular, Article 3 of the draft Resolution clearly specifies the agencies and organizations responsible for implementing the joint use of technical infrastructure facilities and telecommunications infrastructure owned by enterprises in which the State holds 100% of charter capital. Entities eligible to share and jointly use technical infrastructure facilities and telecommunications infrastructure include: (i) military units; (ii) units under the Ministry of Public Security; provincial and municipal police; commune-, ward- and special-zone-level police; (iii) defense enterprises, security enterprises, and units assigned to perform national security and social order and safety missions pursuant to decisions of the Minister of National Defense and the Minister of Public Security.

In addition to enterprises in which the State holds 100% of charter capital, the draft Resolution stipulates that, where necessary and pursuant to decisions of the Minister of National Defense and the Minister of Public Security, state agencies and organizations and public non-business units shall be responsible for allowing the agencies and organizations specified in Clause 2 of this Article to jointly use technical infrastructure facilities and telecommunications infrastructure owned or managed by them to perform national defense missions, protect national security, and ensure social order and safety in accordance with this Resolution and relevant laws. This mechanism is necessary to establish a comprehensive and flexible mechanism for mobilizing resources, ensuring maximum mobilization of suitable infrastructure resources of state agencies, organizations and public non-business units to perform urgent tasks related to national defense and security and social order and safety; thereby helping address resource bottlenecks, shorten implementation time, reduce costs, and improve the efficiency of infrastructure management and utilization...
